AGREEMENT

The website PlantarTech.com (the “Site”) is owned and operated by the Arthrology Designs, LLC (DBA: PlantarTech). Any visit to or use of the Site by you constitutes your agreement that such visit or use is subject to these Terms and Conditions. PlantarTech reserves the right to change these Terms and Conditions at any time, and you are responsible for regularly reviewing these Terms and Conditions if you wish to continue using the Site.  Please read them carefully.

If you visit the Site and do not purchase any products, we do not collect, store or use your personal information for any purpose.  If you purchase products through the Site, we collect and store your name, address and product purchase history for the sole purposes of shipping the products you purchased and following up with you regarding your experience using our products.  We will not share your personal information with any third party.

All software used on the Site is the property of PlantarTech or its software suppliers.  All such content and software are protected by domestic and international copyright and other laws.

PlantarTech grants you a limited license to access and make personal use of the Site solely for the purpose for which it was intended.

You may not use the Site for any other purpose. You may not download, reproduce, duplicate, copy or modify any portion of the Site. The use of spiders, robots, scrapers or any other means, whether through the use of automated software or through a physical or mechanical system, is prohibited.  You may not frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, and page layout) of PlantarTech without the express written consent of PlantarTech. You may not use any meta tags or “hidden text” utilizing the name or trademarks of PlantarTech without the express written consent of PlantarTech.

Any unauthorized use of the Site or violation of any of the foregoing terms shall result in the automatic termination of the foregoing limited license.

AGE LIMITATION

If you are under 18, you may use the Site only under the supervision of a parent or guardian.  If you are a parent or guardian who supervises a minor’s use of the Site, you agree to be bound by these Terms and Conditions with respect to such use.

PlantarTech PROVIDES NO WARRANTY THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE.  THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PlantarTech MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON THE SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PlantarTech DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PlantarTech DOES NOT WARRANT THAT THE SITE OR ITS SERVER IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE FOREGOING DISCLAIMER DOES NOT APPLY TO ANY EXPRESS WARRANTY PROVIDED BY PlantarTech FOR PRODUCTS SOLD THROUGH THE SITE.

LIMITATION OF LIABILITY

Under no circumstances and under no legal or equitable theory, whether in tort, contract, strict liability or otherwise, shall PlantarTech or any of its employees, directors, officers or agents be liable to you or to any other person for any indirect, special, incidental, or consequential losses or damages of any nature arising out of or in connection with the use of or inability to use the Site, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or computer failure or malfunction, even if an authorized representative of A PlantarTech has been advised of or should have known of the possibility of such damages. In no event shall PlantarTech be liable for any damages in excess of the fees paid by you in connection with your use of the Site.

QUANTITY LIMITS

We reserve the right to limit the quantity of products purchased per person, per household or per order. If you are interested in purchasing large quantities of products, please contact us.

INDEMNIFICATION

You agree to indemnify and hold PlantarTech and its officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your activity on the Site or your breach of these Terms and Conditions.

GENERAL TERMS

The failure of PlantarTech to enforce any provision of these Terms and Conditions shall not be construed as a waiver or limitation of PlantarTech’s right subsequently to enforce and compel strict compliance with every provision of these Terms and Conditions.

If any term or provision in these Terms and Conditions is found to be void, against public policy, or unenforceable by a court of competent jurisdiction and such finding or order becomes final and non-appealable, then the offending provision shall be deemed modified to the extent necessary to make it valid and enforceable. If the offending provision cannot be so modified, then the same shall be deemed stricken in its entirety, and the remainder of these Terms and Conditions shall survive with the said offending provision eliminated.

These Terms and Conditions are governed by the laws of the State of California, without giving effect to its conflict of laws principles. You and PlantarTech hereby submit to the exclusive jurisdiction of the state and federal courts located in the City of Los Angeles in connection with any dispute arising from these Terms and Conditions or your use of the Site.
